Terms of Service

2.1 Account Creation

To access certain features of the Service, you must create an account. When creating an account, you agree to:

• Provide accurate, current, and complete information
• Maintain and update your information to keep it accurate and current
• Choose a secure password and keep it confidential
• Not share your account credentials with others
• Notify us immediately of any unauthorized access to your account

2.2 Account Responsibility

You are responsible for all activities that occur under your account. We are not liable for any loss or damage arising from your failure to maintain the security of your account credentials.

2.3 Account Types

We offer the following account types:

• Free Account: Access to basic venue listings and information
• Premium Subscriber: Access to premium intel, comparison tools, and exclusive features

3.1 Pricing

We offer the following products:

• Intel Pack (One-Time): $27 for access to premium venue intel for one specific venue
• Premium Subscription (Monthly): $15/mo for unlimited access to all venue intel and premium features

All prices are in USD and subject to change with 30 days' notice to existing subscribers.

3.2 Payment Processing

Payments are processed securely through Stripe. By providing payment information, you authorize us to charge your payment method for all fees incurred. You represent that you have the legal right to use any payment method you provide.

3.3 Billing Cycle

Premium subscriptions are billed on a recurring monthly basis. Your subscription will automatically renew each month unless canceled before the renewal date. You will be charged at the beginning of each billing cycle.

3.4 Cancellation

You may cancel your subscription at any time through your account settings. Cancellation will take effect at the end of your current billing period. You will continue to have access to premium features until the end of the paid period.

If a payment fails, we will attempt to charge your payment method up to three times. If payment continues to fail, your subscription will be suspended, and you will lose access to premium features until payment is successfully processed.

5.1 Our Content

The Service, including all content, features, and functionality (including but not limited to text, graphics, logos, images, venue intel, reviews, compilations, and software), is owned by The Brooklyn Wedding and is protected by copyright, trademark, and other intellectual property laws.

5.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial use in accordance with these Terms. This license does not include the right to:

• Reproduce, distribute, or publicly display our content
• Modify or create derivative works
• Use our content for commercial purposes
• Remove copyright or proprietary notices

5.3 Trademarks

"The Brooklyn Wedding" and our logo are trademarks of The Brooklyn Wedding. You may not use these trademarks without our prior written permission.

6.1 Reviews and Ratings

Users may submit reviews and ratings of venues. By submitting a review, you:

• Represent that the review is based on your genuine experience
• Agree not to post false, misleading, or defamatory content
• Grant us a perpetual, worldwide, royalty-free license to use, modify, and display your review
• Understand that reviews may be moderated and removed if they violate our policies

6.2 Review Guidelines

Reviews must:

• Be based on a genuine, first-hand experience
• Be relevant to the venue being reviewed
• Be respectful and constructive
• Not contain profanity, hate speech, or discriminatory language
• Not include personal information about individuals
• Not be posted in exchange for compensation (unless disclosed)

6.3 Moderation Rights

We reserve the right to review, edit, or remove any user-generated content that violates these Terms or is otherwise objectionable, without prior notice.

7.1 Venue Information Accuracy

We strive to provide accurate and up-to-date venue information, but we do not guarantee the accuracy, completeness, or reliability of any content. Venue details, pricing, policies, and availability are subject to change without notice. You should always verify information directly with venues before making decisions.

7.2 No Professional Advice

The information provided through the Service is for informational purposes only and does not constitute professional advice. We are not responsible for any decisions you make based on information obtained through the Service.

7.3 Third-Party Relationships

We are not agents or representatives of any venues listed on our Service. We do not endorse or guarantee the quality, safety, or legality of any venue. Any contracts or agreements you enter into with venues are solely between you and the venue.

7.4 User Reviews

Reviews and ratings represent the opinions of individual users and do not reflect the views of The Brooklyn Wedding. We do not verify the accuracy of user-submitted reviews.

10.1 Informal Resolution

Before filing a claim, you agree to contact us at legal@thebrooklynwedding.com to attempt to resolve the dispute informally. We will work with you in good faith to reach a resolution.

10.2 Arbitration Agreement

If informal resolution fails, any dispute arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

• Arbitration will be conducted in New York, NY
• The arbitrator's decision will be final and binding
• You waive your right to a jury trial and to participate in class action lawsuits

10.3 Exceptions

Either party may seek injunctive relief in court for intellectual property infringement or violation of confidentiality obligations.

10.4 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to conflict of law principles.

11.1 Termination by You

You may terminate your account at any time by contacting us or using the account closure feature. Upon termination, you will lose access to premium features at the end of your billing period.

11.2 Termination by Us

We reserve the right to suspend or terminate your account immediately, without prior notice, if:

• You violate these Terms
• You engage in fraudulent activity
• Your account is inactive for an extended period
• We are required to do so by law

11.3 Effect of Termination

Upon termination, your right to use the Service will cease immediately. Sections of these Terms that by their nature should survive termination will survive, including intellectual property provisions, disclaimers, and limitations of liability.

14.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and The Brooklyn Wedding regarding the Service.

14.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

14.3 Waiver

Our failure to enforce any right or provision of these Terms will not constitute a waiver of that right or provision.

14.4 Assignment

You may not assign or transfer these Terms or your account without our written consent. We may assign these Terms without restriction.
